Overview of Legal and Compliance team:
BlackRock’s Legal and Compliance team works with business teams to develop investment management products and business solutions that comply with the numerous legal and regulatory requirements to which BlackRock is subject and to deploy capital managed on behalf of clients. Legal and Compliance is responsible for, among other things, overseeing regulatory matters; coordinating litigation and legal proceedings; negotiating and structuring contracts and other complex transactions; providing ongoing legal advice across investment platforms regarding new and existing products, strategies and investments; establishing legal and compliance policies and procedures that meet applicable regulatory requirements and testing the operative effectiveness of those policies and procedures and conducting training.
Brief Description of the Role:
BlackRock Investment Management (Taiwan) Limited (BlackRock Taiwan) has an opening for a VP role within the Legal and Compliance function. This individual will provide legal support for product registration and launches, product maintenance and distribution business. The role will also involve providing legal and regulatory advice to other parts of the business including Portfolio Management, Global Product Solutions, Client Business, Operations and Risks etc. The individual will need to grow and adapt with the fast-growing business of BlackRock Taiwan and be willing to develop new skills and knowledge. The role will be based in Taiwan and report to the Head of Legal within BlackRock Taiwan.
Responsibilities:
- Advise on the legal and regulatory aspects of different parts of the business including fund product launches/restructuring (including mutual funds and exchange traded funds), marketing advice, other regulatory advice.
- Negotiating different forms of agreements or contracts relating to the intermediary business of BlackRock’s funds and products within or outside of Taiwan (where relevant)
- Liaising with Taiwan internal and external advisors/stakeholders and internal control groups to lobby for BlackRock’s initiatives and respond to consultation papers
- Providing support and advice to BlackRock Taiwan’s Board of Directors as appropriate
- Providing legal advice and support to ensure that the governance and control framework has robust processes and procedures in place to meet all legal and regulatory obligations
- Providing support and advice in connection with financial inspections and internal audit as appropriate
- Effective engagement and management of Taiwan external counsel, including cost management
- Working with other functions including overseas colleagues to ensure effective delivery of L&C deliverables in projects which involve cross-functional collaboration
- Participating in global and/or regional Legal and Compliance initiatives and projects and working with Legal and Compliance colleagues from other BlackRock offices to ensure global best practice and consistency wherever possible.
Qualifications:
- A Taiwan or US (or other western jurisdictions such as Canada, UK or Australia etc.) qualified lawyer that has at least 6 years of PQE
- Candidates from funds department of law firms or who have in-house lawyer experience in the Legal department of asset management companies are preferred
- Successful candidate should have a prior experience and knowledge on advising on exchange traded funds and/or SFB authorized SITE funds. Knowledge on other fund domiciles is also preferable (e.g. UCITS SICAV, Cayman Unit Trusts etc.)
- Experience in co-ordinating with SITCA and SFB is essential, and experience in dealing with the Taiwan Stock Exchange, Taipei Stock Exchange, and the Examination Bureau under FSC would be preferrable
- Good understanding of the regulatory environment in Taiwan
